These terms and conditions govern the use of the website of Emmers Ruitersport BVBA with company number BE0478.172.764. The terms of sale also apply whenever a reservation or order is placed through the webshop of Emmers Equestrian via www.emmers.eu.

Placing an order on the website includes the acceptance of these terms and conditions. To place an order, accepting the terms is necessary. If you order, you are declaring to know the terms and conditions of the seller and you are accepting them. With each order, the general conditions, at that time recorded on the website, are applicable, with the exclusion of any older or newer provisions. If one of these conditions for any reason would not be legally valid, the remaining conditions remain fully applicable. What is not explicitly provided in these terms and conditions shall be governed by the provisions of Belgian law.

Minors or other incapacitated should be represented by their parents or legal representative who is also bound by these terms and conditions and must complete the order form itself or the incapacitated must grant explicit permission to do so, otherwise, the order will not be accepted. Anyone who places an order, confirmed by the order to be a natural person and not a trader or at least not ordering as a trader.

These general conditions of sale, apply only to consumers (within the meaning of the Law on market practices and consumer protection of April 6, 2010). The seller commits himself to process the orders, placed on the website, while stocks last and within the limits laid down in these conditions. The online order can only be processed if the customer is clearly identified CFR. according to Art. 9.
The seller reserves the right to refuse orders in case of ‘serious suspicion of abuse of rights' or bad faith, strongly suspected to seller unacceptable commercial purposes or to depletion of the stock of a particular article.
An order is only final after the acceptance of these general sales conditions, the prices and the description of the offer. If something in the offer or after order, was insufficiently clear, the customer can always contact the online customer service for further information through the contact form under 'contact us', by e-mail to hello@emmers.eu or by phone +32( 0 )11 664 773. All questions will be answered as soon as possible.

The prices are stated on the website at the time of ordering. All prices include 21 % VAT unless stated otherwise.
The cost of shipping will be specified when ordering before your order has been placed. It can then still be dispensed with the order. Delivery is free for all orders over €100 in Belgium and the Netherlands. 

If payment is made by bank transfer, the order will be executed after receipt of the payment. Pending payment, the ordered items will be reserved for a 7 day period in which the transfer must have happened and the seller must have received payment, if not the order will be invalidated.
It can also be paid with Emmers gift certificates. When the system has accepted the above payment, the order will be confirmed by e-mail.

The delivery of the ordered item(s) is done at the address given by the customer, by withdrawal in a post office or postal point or by collecting at the Emmers Equestrian store of your choice. The chosen option affects the delivery.

The delivery period commences only upon receipt of payment, even if paid by bank transfer. We target for the shortest possible delivery time. The delivery is at least one day and up to 30 days after receipt of payment for delivery in Belgium, and between 2 and 30 days in other countries.
The seller is not liable for any delay or failure of delivery by a fault of the carrier, but we do everything within our power to help you as fast as possible. In case the availability of your chosen product for any reason should be incorrect, we will notify you as soon as possible and find a suitable solution.

We aim to completely satisfy you with every purchase at Emmers Equestrian and strive for excellent quality and outstanding customer service. However, if for any reason you wish to return or exchange (a part of) your purchase, please contact hello@emmers.eu for a return form and send your purchase back to us within the next 5 calender days, together with the products in their original packaging with label. You may also return or exchange the products in one of the Emmers Equestrian stores. Unless a mistake has been made by Emmers Equestrian, return is always at the expense of the customer. For shipment of the exchanged product, transportation costs will be charged.

In case of a correct return, the customer will be refunded or receive a voucher if agreed by the customer. In any case, a return is only accepted if the item has been sent back undefiled, undamaged and unworn and in the original packaging.

Note: these return conditions do not apply to personalized products, i.e. products that have been ordered in a specific colour or size for the customer.

Please inform us in case of a problem or defect with the received item(s), with respect to the delivery of an article. Contact us via e-mail to hello@emmers.eu. We will examine how to best resolve the issue and will ask you to return the damaged item(s) with a return label provided by Emmers Equestrian. We will also send you a return form. Please complete the form with a description of the problem and your account number for the refund.

The cost of shipment (providing a return label) of the damaged product(s), shall be taken by the seller. The seller is not liable for odds, accident, misuse or wrong manipulation of an article by the customer. An article with an acceptable claim will be repaired or replaced free of charge. If the costs of repair are disproportionate, the seller reserves the right to replace the item or exchange it with a similar product.

All items ought to be returned in an orderly fashion; undefiled, undamaged and unworn and in the original packaging. This way we can resolve your complaint as fast as possible.

All products are sold as-is unless otherwise stated, and may not always be available at every sales outlet. Products may differ from their photos; in some cases, correct imagery is not available, which means the product photo may vary from the actual product. We make every effort to ensure that the colors on the website match as closely as possible to those of the actual product. However, due to technical limitations, some colors may differ. Furthermore, for certain items where no photo is available in the correct color, we use color swatches. Therefore, always pay close attention to the color description of your selected item. After placing your order, you will receive a confirmation email with the chosen color and size.

The customer accepts electronic evidence. The customer is solely and exclusively responsible for the accuracy of any information that he or she provides to the seller.
In a first online order, the customer must follow the registration procedure. After that, the customer needs only to log in again to place a new order.
The final confirmation of the order by the customer implies acceptance of the order at the stipulated price. Ratification of the customer replaces the signature and full acceptance of all transactions via the website.

The seller's website is intended to provide general information to the customer about the products and activities of the seller. Regarding access, the ordering process, delivery or other services, the seller has only an exercise commitment.
The seller is entitled to suspend in whole or in part at any time the site or put it on hold for maintenance, updating or any other reason, even without prior warning.
The seller cannot be held liable for any inconvenience or damage arising from the use of the Internet, by any failure of the system, the intrusion of outsiders or of a virus, nor for any third party to this installed or processed information or any that can be regarded as force majeure.

All parts of the site of the seller are the exclusive property of Emmers Ruitersport BVBA and copyrighted, or are being used with the permission of the owner.
To set up a link between the seller's website and users, having their own website, but also for personal use, permission explicitly must be given by the seller. Reproduction of the website is strictly prohibited.

All inquiries, complaints, or remarks can be sent to our customer service via hello@emmers.eu. We make every effort to handle your complaint within 3 working days of receipt. If we cannot immediately resolve your complaint, we will inform you of the expected timeframe. We will keep you informed of any investigation.

Any costs arising from a return shipment or additional shipment to countries outside the European Union as a result of a complaint are the responsibility of the customer. All agreements we conclude with our customers, regardless of their place of residence, are governed exclusively by Belgian law, and in the event of disputes, only the competent Belgian courts shall have jurisdiction. If, for reasons of international law, another law applies, the Belgian Law on Market Practices and Consumer Protection will be the primary reference in the interpretation of these general terms and conditions.

In the event of an out-of-court settlement of the dispute, the Consumer Ombudsman Service of the Federal Public Service Economy is competent to receive any requests for out-of-court settlement of consumer disputes.
